Abstract
Bakalářská práce se zabývá problematikou úpravy nekalé soutěže v České republice. Úvod je věnován termínům souvisejících s nekalou soutěží. Jádrem práce je zachycení právní úpravy nekalé soutěže podle českého právního řádu (s porovnáním současné úpravy podle občanského zákoníku s úpravou platnou do roku 2013 podle obchodního zákoníku) i podle evropských předpisů. Práce rozebírá praktické příklady nekalé soutěže jak z českého prostředí, tak i případ projednávaný Soudním dvorem EU. Práce se věnuje i ochraně spotřebitelů proti nekalým obchodním praktikám. V závěru práce je na základě předchozích příkladů rozebírána volba optimálního právního prostředku na ochranu proti nekalosoutěžnímu jednání.
The bachelor's thesis deals with the regulation of unfair competition in the Czech Republic. The introduction is devoted to an explanation of the terms related to unfair competition. The core of the work is to capture the legal regulation of unfair competition in the Czech law system (with the comparison of the current legislation under the civil code with the legislation that was valid untill 2013 under the commercial code) and in accordance with the European regulations. The thesis analyzes some practical examples of unfair competition both from the Czech environment, and a case discussed by the Court of justice of the European Union. The thesis is dedicated to protection of consumers against unfair commercial practices, too. The conclusion is based on the given examples and discusses the choice of the optimal legal means of the protection against unfair competition.
