dc.description.abstractBakalářská práce se zabývala trestem smrti, jenž přináší nikdy nekončící diskuzi o jeho místě v právních řádech různých zemí. Pozornost byla v této souvislosti zaměřena do prostředí Vězeňské služby České republiky, konkrétně na zaměstnance věznic typu C - s ostrahou a na jejich postoj k přítomnosti trestu smrti v právním řádu České republiky, s ohledem na četnost jejich kontaktu s vězněnými osobami. Teoretická část se na samém začátku věnovala vysvětlení některých základních pojmů a dále pak předložila pohled do historie trestání smrtí, kde byly zmíněny zejména prvotní zákony, dotýkající se trestu smrti, povaha zločinů trestaných smrtí, způsoby popravování a také několik, pro český národ, významných exekucí. Byly zde zmíněny nejdůležitější osobnosti odpůrců trestu smrti a reformistů hrdelního práva ve světovém měřítku jakož i na území českého státu a snaha o posun k humánnějším způsobům popravování. Text dále předkládá pohled na současnou praxi v tomto ohledu užívanou v některých státech světa a postoj mezinárodních institucí k tématu trestu smrti s jejich snahou o zrušení trestu smrti v celosvětovém měřítku. V závěru teoretické části byly zmíněny možné potíže doprovázející exekuce a nastíněna dilemata, která rozdělují společnost na zastánce a odpůrce trestu smrti a rozpoutávají permanentní diskusi, která se dotýká i zaměstnanců Vězeňské služby České republiky zejména, když jejich profese vyžaduje kontakt s osobami odsouzenými za zvlášť závažné a brutální zločiny. Úkolem praktické části bylo, na vzorku 70 respondentů pracujících ve věznici typu C - s ostrahou, ověřit předpoklad, že postoj těchto zaměstnanců k trestu smrti je do značné míry ovlivněn právě kontaktem s vězněnými osobami. Výsledky šetření ale poukázaly na fakt, že v rozporu s předpokladem autora této práce, nemá kontakt zaměstnanců zmíněných věznic s odsouzenými osobami rozhodující vliv na utvoření názoru, že existence trestu smrti v českém právním řádu by snížila procento násilných trestných činů a lze se proto domnívat, že tento úsudek utváří mnoho různých dalších faktorů, které se mohou stát v budoucnu předmětem dalšího šetření.cs
dc.description.abstractBachelor thesis dealt with the death penalty, leading to an endless debate about its place in the legal systems of different countries. Attention was focused in this context on the environment of the Prison Service of the Czech Republic, namely C-type prison staff - with surveillance, and their attitude towards the presence of the death penalty in the law of the Czech Republic, regarding the frequency of contact with prisoners. At the very beginning, the theoretical part gave an explanation of some basic concepts and then presented an insight into the history of punishment by death, where the primary laws affecting the death penalty were particularly mentioned, and the nature of the crimes of prisoners died, execution methods and some famous executions for the Czech nation. There were mentioned the most important personalities of the opponents of the death penalty and capital punishment law reformists in the world as well as the territory of the state and trying to shift to more humane methods of executions. The text also presents a view of current practice; in this regard it is used in some countries of the world and there is also the attitude of international institutions on the death penalty in their effort to abolish the death penalty worldwide. In the end of the theoretical part potential problems accompanying the execution were discussed and outlined the dilemmas that divide society into advocates and opponents of capital punishment and launch a permanent debate, which touches the Prison staff, particularly when their profession requires contact with persons convicted of serious and violent crimes. The task of the practical part was - on a sample of 70 informants working in the prison of type C with surveillance - to verify the assumption that the attitude of these employees to the death penalty is largely influenced by contact with prisoners. However, the results of the investigation pointed to the fact that contrary to the assumption of the author of this work, no contact of prison staff with convicted persons has decisive influence on the formation of the opinion, that the existence of capital punishment in the Czech legal order would reduce the share of violent crime and could therefore be considered that this opinion constitutes a variety of other factors that may become the subject of further investigation in future.en
