Práva pacientů v kontextu s neodkladnou péčí
Abstract
Bakalářská práce se zabývá znalostí práv pacientů a druhů odpovědnosti zdravotnickými záchranáři. Teoretická část charakterizuje zdravotnickou záchrannou službu, zdravotnického záchranáře a sděluje pár slov o historii. Dále jsou zde v krátkosti vypsány důležité body z Úmluvy o lidských právech a biomedicíně a Listiny základních práv a svobod a charakterizován postup Lege artis. Poté byla vypsána práva pacientů, která jsou v kontextu s neodkladnou péčí důležitá. V krátkosti zde byly připomenuty i povinnosti pacientů a práva zdravotnických záchranářů. Ohledně právní odpovědnosti v teoretické části byly vypsány i přestupky a trestné činy, kterých by se zdravotník mohl dopustit. V závěru teoretické části je uvedeno i několik bodů ohledně stížností podávaných pacienty a pár slov k velmi aktuálnímu tématu GDPR.Ve výzkumné části byly analyzovány dotazníky, kterými byla prověřena znalost zdravotnických záchranářů o právech pacientů a druhů odpovědnosti. Výstupem z práce bylo vytvoření článku připraveného k publikaci v odborném periodiku. Článek popisuje, které znalosti zdravotnických záchranářů v právní problematice je třeba zlepšit a doplnit, aby bylo zredukováno co nejvíce situací, kdy dojde k porušení práv pacientů a naplnění právní odpovědnosti.
Bachelor thesis focuses on knowledge of patient rights and liability types of paramedics. The theoretical part describes the emergency medical service, profession of a paramedic and briefly looks back into history. Moreover this thesis lists important points from the 'Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine' and from the 'Charter of Fundamental Rights and Freedoms' and Lege Artis process. Then the rights of patients that are important in the context of emergency care are listed. This thesis briefly addresses the obligations of patients and rights of paramedics. Regarding the legal liability in the theoretical part the thesis lists offenses and crimes that may be committed by a paramedic. At the end of the theoretical part the complaints from clients are discussed as well as current topic of GDPR. In the research part of this thesis the results from issued questionnaires were analyzed. Questionnaires were given to serving paramedics to evaluate their knowledge of patients' rights and types of liability. The output of this thesis was creation of an article prepared for publishing in an expert magazine. The article describes which knowledge of paramedics in the field of law needs to be addressed to decrease the number of violations of patients' rights as much as possible.
