Abstract
Tato bakalářská práce se zabývá problematikou obchodního zastoupení, konkrétně pak smlouvou o obchodním zastoupení, a to jak z teoretického hlediska, tak i z hlediska praktického. Pro uvedení do problematiky bude nejdříve představen historický vývoj samotného obchodního zastoupení od jeho první podoby, kterou lze považovat za předchůdce dnešní podoby obchodního zastoupení, a smlouva o něm. Dále jeho vymezení, vývoj právní úpravy i srovnání smlouvy o obchodním zastoupení s některými dalšími smlouvami příkazního typu. Součástí teoretické části je také porovnání smlouvy o obchodním zastoupení podle předcházející úpravy s úpravou nynější, podle které je dnes obchodní zastoupení upraveno. V praktické části bude smlouva o obchodním zastoupení nejdříve ukázána a rozebrána na konkrétním příkladu smlouvy o obchodním zastoupení a v poslední části této práce je pak navrhnuta její možná podoba aplikovaná na fiktivním příkladu.
This bachelor thesis deals with issues of dealership namely the contract of business representation both from theoretical point of view, as well as, the practical point of view. This thesis covers historical development of dealership itself, first, it is introduced from its first appearance which can be considered as the forerunner of today's form of dealership and a contract about it. Furthermore, its definition, the development of legal regulations and the comparison of the contract of business representation with some other contracts of mandate. Part of the theoretical part is also a comparison of the contract of business representation according to the previous regulation with the current regulation, according to which dealership is now regulated. In the practical part, first, the contract of business representation is shown and discussed on a specific example of the contract of business representation and the last part of this thesis is a draft of the contract of business representation.
