dc.description.abstractBakalářská práce se zabývala problematikou ústavní výchovy, která vycházela z působnosti Okresního soudu v České Lípě v letech 2006 - 2008. Jejím cílem bylo zjistit důvody, pro které jsou podávány k soudu v České Lípě návrhy na nařizování ústavní výchovy. Dále zjistit, zda existuje i jiná možnost než nařízení ústavní výchovy, je-li vážně ohrožena nebo narušena výchova dítěte. V teoretické části byla objasněna právní úprava ústavní výchovy. Byla popsána činnost orgánu sociálně právní ochrany dětí a bylo specifikováno stěžejní zákonné vymezení ústavní výchovy ze zákona o rodině. Pečlivě byl charakterizován průběh ústavní výchovy, její nařízení, realizace a zrušení ústavní výchovy. Byly uvedeny důvody nařízení ústavní výchovy a popsán systém zařízení pro výkon ústavní výchovy a zařízení pro děti a mládež. Společně s problematikou ústavní výchovy byla vysvětlena i ochranná výchova. Teoretická část bakalářské práce se rovněž zabývala institutem náhradní rodinné péče, kdy byla popsána tato forma péče o děti a uvedeny jednotlivé možnosti. Praktická část byla zaměřena na ověřování předem stanovených předpokladů a jejich vyhodnocení. Zabývala se počtem umisťovaných dětí do ústavní výchovy z důvodů narůstajících poruch chování a zda tento počet narůstá. Zjišťovala, jaké jsou důvody pro nařízení ústavní výchovy a zda jsou tyto konkrétně uvedeny v zákoně o rodině. Přínosem práce bylo seznámení se s problematikou ústavní výchovy z hlediska soudní praxe a možnostmi alternativních řešení, je-li vážně ohrožena nebo narušena výchova dítěte nebo nemohou-li z jiných závažných důvodů rodiče výchovu dítěte zabezpečit.cs
dc.description.abstractThe Bachelor thesis deals with matters of institutional upbringing, which were based on the competence of the District Court in Ceska Lipa from 2006 to 2008. The aim was to elicit reasons for submitting petitions for decreeing institutional upbringing at the Ceska Lipa Court and find out another posibility if upbringing of a child is seriously endangered or disrupted. In the theoretical part there was legislation of institutional upbringing clarified. The activity of the Authority of Social and Legal Protection was described and there was specified the core legal definition of institutional upbringing from the Family Law. The process of institutional upbringing was thoroughly described, including its decreeing, realisation and reversal. There were recited reasons for decreeing institutional upbringing and described the system of the child care institutions and facilities for children and young. Together with issues of institutional upbringing there was alternative family care explained . The theoretical part of the Bachelor thesis also dealed with the Institute of Alternative Family Care, where the form of child care was described, and listed individual options. The practical part focused on verification of predetermined assumptions and their evaluation. It addressed to the number of children placed to institutional upbringing due to increasing disorders of behaviour - is it increasing , what are the reasons for decreeing institutional upbringing and are they specifically mentioned in the Family Law. The thesis benefits were familiarizing with the institutional upbringing problems from the judicial practice standpoint and alternative solutions if the child´s upbringing is seriously endangered or disrupted or if parents are not able to provide child´s upbringing due to significant reasons.en
