Abstract
Tato bakalářská práce se zabývá právní úpravou nájmu, převážně prostor sloužících k podnikání v rámci legislativy České republiky. Hlavní náplní této práce je seznámení se s problematikou nájmu, charakterizováním nájemní smlouvy a porovnáním staré a nové právní úpravy nájmu. Teoretická část práce se zabývá obecnou právní úpravou nájmu a nájmu prostor sloužících k podnikání. Jsou zde popsána veškerá práva a povinnosti stran uzavírajících nájemní smlouvu. Druhá část teoretické práce je věnována porovnání staré a nové úpravy legislativy, která se nájmu týká, zvláště prostor sloužících k podnikání. Následující kapitoly se věnují konkrétní nájemní smlouvě vybrané společnosti, která sídlí v pronajatých prostorách. Nájem firma sjednala před vznikem legislativy nové. Praktická část je tedy věnována rozboru smlouvy a srovnání s novou právní úpravou, spolu s návrhem o vylepšení smlouvy o položky dle nové legislativy. Výsledkem bakalářské práce je nově vypracovaná nájemní smlouva, která podléhá platné legislativě České republiky.
This thesis deals with the legal aspects of tenancy in practice, major part consists space used for business within legislation of Czech Republic. The main content is to get familiar with the issues of tenancy, characterization the contract on lease and comparing old and new legislation of tenancy. The theoretical part deals with the general legislation on lease, and the lease of space, used for business. There are a description of all rights and obligations of both parties to the contract. Following theoretical part compares old and new legislation, that describe tenancy, especially the lease of space, used for business. Next chapters are dedicated to specific tenancy contract of one organization which has a residency in leased spaces. The contract of tenancy was entered into before creation new legislation. Practical section describes the contract and compare them with the new legislation and refill contract of some new items, that new legislation offers. The result of this thesis is new document of tenancy contract, that is elaborated within valid legislation of Czech Republic.
