dc.description.abstractThis bachelor thesis deals with the child support problems. The goal was to map over the problems under current law from the civil as well as the criminal point of view. In the theoretical part the sources of law have been described which the child support duty comes from (civil law, criminal law). The duties to support haven been described, the focus was on the child maintenance. Establishment, process, duration, expiration and scope have been described as well as the subjects, their specifications, characteristics, relationships between the particular maintenance kinds, the social function they have, with references to the Family Act and the Civil and Crown Law. The criminal aspects of the default (non-payment by the debtor) have been described, what penal offence it is, its reasons and sanctions, and furthermore the possibilities how to meet one´s support obligation by subsequent payments. The practical part focused on verification and evaluation of three pre-set assupmtions using content analysis of empiric data coming from the trial court records. The work analyses the proportion of working / not working people in default of a child maintenance, furthermore the proportions of those persons with a record, and last but not least the way how the active repentance is being used. All the findings and the contribution of the work for the theory and the practice have been summarized and evaluated in the closing part. Proposed measures close the work.en
dc.description.abstractBakalářská práce se věnovala problematice vyživovací povinnosti k dítěti. Cílem bylo zmapovat problematiku v současném právním rámci a to v rovině občansko-právní i rovině trestní. V teoretické části bylo popsáno z jakých pramenů práva vychází samotná vyživovací povinnost, ať už z občanského či trestní práva. Dále byly popsány jednotlivé druhy vyživovacích povinností, kdy stěžejní částí byla problematika vyživovací povinnosti k dětem, byl popsán vznik, průběh, trvání, zánik, rozsah a subjekty, jejich specifika, charakteristiky, vztahy mezi jednotlivými druhy výživy, jakou plní společenskou funkci, jaké je opora v zákoně o rodině, občanském právu, trestním právu. Byla popsána trestní stránka neplnění si vyživovací povinnosti, o jaký se jedná trestní čin, jeho důvody a sankce, a dále i možnosti dodatečného splnění si svojí vyživovací povinnosti. Praktická část byla zaměřena na ověření tří předem stanovených předpokladů a jejich vyhodnocení za využití obsahové analýzy empirických dat ze spisové dokumentace. Práce se zabývala rozborem podílu jakým se na neplnění vyživovací povinnosti podílejí neekonomicky aktivní osoby, dále jaký je podíl těchto osob s trestní minulostí a v neposlední řadě jak využívají institutu účinné lítosti. V závěru práce byly shrnuty a zhodnoceny všechny zjištěné skutečnosti a přínos práce pro teorii a praxi. Celá práce byla ukončena navrhovanými opatřenímics
