Abstract
Tato bakalářská práce se zabývá právní úpravou kupní smlouvy dle zákonů České republiky. Teoretická část se zabývá charakteristikou kupní smlouvy, jejími náležitostmi, právy a povinnostmi z kupní smlouvy plynoucími a dalšími ujednáními souvisejícími s pojmem koupě v české legislativě. Navazující praktická část se zabývá rozborem dvou kupních smluv, které byly reálně použity v praxi a poskytnuty pro účely této práce. Jednou z kupních smluv je prodej respektive koupě věci nemovité přičemž původní návrh byl sepsán ve prospěch prodávajícího a revidován právním zástupcem kupujícího na neutrálnější verzi. Druhá kupní smlouva, která je v této práci analyzována, se týká věci movité. V závěrečné části této práce je provedeno porovnání těchto dvou smluv včetně návrhu na doplnění chybějících ujednání. Cílem práce je navržení vlastní kupní smlouvy na věc movitou mezi nepodnikateli.
This bachleor thesis deals with Legal regulation of the purchase contract according to the laws of the Czech Republic. Theoretical part deals with the characteristics of the purchase contract, its particulars, the rights and obligations of the purchase contract and other agreements related to the concept of purchase in the Czech legislation. The following practical part deals with the analysis of two purchase contracts, which were actually used in practice and provided for the purposes of this work. One of the purchase contracts is the sale/purchase of real estate, with the original proposal being drawn up for the benefit of the seller and revised by the buyer's legal counsel to a more neutral version. The second purchase contract, which is analyzed in this thesis, concerns the movable thing. The final part of this work compares these two contracts, including the proposal to supplement the missing arrangements. The purpose of the thesis is to propose a contract of sale for movable property between non-entrepreneurs.
